Divorces filed outside Italy will be considered valid only after being registered at your Comune <\/em>of AIRE registration.<\/p>\n

Based on reciprocity, a judgment of divorce from a State Court in the United States is generally recognized in Italy, but, ultimately, the final decision is made by the Italian\u00a0Comune<\/em>\u00a0of AIRE registration.<\/p>\n

A foreign divorce decree for a marriage that occurred in Italy will be registered in the Italian\u00a0Comune\u00a0<\/em>where the marriage was celebrated. A foreign divorce decree for a marriage that occurred abroad will be registered in the Italian\u00a0Comune\u00a0<\/em>where the marriage was registered.<\/p>\n

A fundamental requirement to be able to register a divorce, is that the<\/strong><\/u> marriage the divorce decree refers to, MUST have already been registered in Italy if it transpired outside Italy<\/u><\/strong>. If the foreign marriage was never registered, you must submit a request to register the marriage first (see the\u00a0MARRIAGE section<\/strong>\u00a0of this website<\/a>) before proceeding with the divorce registration.<\/p>\n

Only \u2018certified copy\u2019 decrees<\/strong>\u00a0will be accepted<\/u>\u00a0and will remain on file at this Consulate General and will\u00a0not<\/strong>\u00a0be returned to the applicant.<\/p>\n
