We inform all Italian citizens, parents of minor children, that starting from June 14th, 2023 it is no longer be necessary to present the act of consent of the other parent for the purpose of issuing their passport, pursuant to D.L. 69/2023.
Specifically, Article 3-bis of Law 1185/1967 indicates that, when there is a concrete and present danger that due to the transfer abroad this may escape the fulfillment of his obligations towards the children, it will be possible for the other parent to request an injunction to the release of the passport.
The request may be submitted to the competent judge at the ordinary Court where the minor has his permanent residence or, if the minor resides abroad, the Court in whose district his municipality of AIRE registration is located.
For the purposes of issuing passports for minors, however, the obligation of presenting the act of consent signed by both parents -or by those who exercise parental responsibility- remains.
